Top Tips for Documenting Evidence in South Florida Premises Liability Cases

Posted on February 10, 2025

The owner of a South Florida property is responsible for ensuring the safety of those that are legally on the property; this is called a duty of care. If you slip, trip, fall, or are otherwise injured on someone else’s property, it may have been because the property owner breached this duty of care by failing to keep their property safe.  Premises liability cases are complex, though, because the property owner will likely try to blame you for your injury by saying that you should have been more careful. To build a strong case, you will need to meticulously document evidence to prove that the property owner was responsible. Here are some steps that can help bolster your case in South Florida:

  • Immediately after the incident, if you are able, take photos and videos showing the dangerous situation that caused you to fall. The property owner may rush to fix the dangerous condition once you are injured, so if you wait to do this, the evidence may be gone. Similarly, if there is anyone who witnessed your fall, take down their name and contact information so that your attorney can contact them to corroborate your story.
  • Contact the store management to let them know you were injured so they document that the injury occurred. Also let them know that you would like a copy of the security camera footage. Typically, security camera footage is erased at regular intervals, and you will want to ensure that this evidence is preserved.
  • Seek immediate medical care. Your medical record from the injury will provide the cornerstone of your case to prove the severity of your injuries.
  • Save all your clothes (including your shoes) that you were wearing and don’t wash them. Your attorney may want them as evidence.

As soon as you are physically able, contact a South Florida personal injury attorney, like ECanter Lawyers, to investigate the incident and preserve as much data as possible. As part of our investigation, we will review all of the aforementioned evidence, as well as research if the venue has a history of building code or safety violations. We may also seek advice from engineers or other safety specialists to provide expert opinions.

If the evidence shows that you have a legal case against the property owner, we will initiate negotiations with the opposing party to fight for the money that you deserve. You are entitled to compensation for your economic as well as noneconomic costs, like pain and suffering. If the property owner does not offer an acceptable settlement, we will argue the case in court.
