Questions to Ask When Hiring a Personal Injury Attorney

Here are some important questions to ask when meeting with a personal injury attorney to help you choose the right one for you:

  • Do you have experience trying cases like mine in court? There are many different types of personal injury cases – automobile accidents, slip and fall injuries, workers compensation, and products liability just to name a few. You want an attorney who knows and ins and outs of working on cases similar to yours. You also want to make sure your attorney has won similar types of cases in court. While most personal injury cases settle out of court, if the other party refuses to offer an acceptable settlement, it’s essential that your attorney is prepared to fight them in court.
  • Do you see any potential issues with my case? Personal injury cases, like all legal cases, have strengths and weaknesses. In general, if an attorney is willing to take your case, they believe that the strengths outweigh the weaknesses and that they can win your case. However, they should be able to explain any weaknesses that the other side may try to exploit so you are not blindsided later on.
  • What is my case worth? The value of your case will be dependent on the severity of your injuries, the impact that the injuries will have on your life and that of your family, your actual economic losses, and estimated future economic losses. While you attorney will not be able to tell you specifically how much your case is worth, they should be able to give you a range based on their past experience.
  • How do you charge for your services? Most personal injury attorneys work on contingency to cover their fee. This means that you pay them a percentage of the compensation that they recover for you. The percentage ranges from around 20% to around 40%. Paying a lower fee is not necessarily better – an attorney that charges more may invest more into your case to win a larger settlement or verdict for you. On top of the fees are the out-of-pocket expenses, such as filing fees, records fees, expert fees, etc. You will want to ask the attorney if these come out of the contingency or if they are charged separately – different attorneys use different approaches.
