Is That Really True? Motor Vehicle Accident Myths

Last month, we debunked some popular myths about personal injury law. This month, we’re continuing to debunk legal myths – this time myths involving motor vehicle accidents. Many accident victims miss out on thousands of dollars of compensation because they believed legal myths instead of meeting with a personal injury attorney who could give them actual legal advice.

Myth: I was in a car accident but felt fine afterwards, so no need to visit the doctor.

Reality: During a traumatic event, like a car crash, your body’s endocrine system releases adrenaline, a hormone that prepares your body for “fight for flight.” As part of this response, you may not feel pain or injuries, so many accident victims don’t realize the full extent of their injuries. Even if you feel fine after a car crash, it’s important to be checked by a healthcare professional within 24 hours of your accident. If it turns out that you are injured, the longer that you waited to see the doctor, the easier it will be for the opposing party to claim that your injuries were caused by something other than the accident. Moreover, your PIP coverage requires that you visit a doctor within 14 days of the accident in order to receive your full PIP benefits.

Myth: I was in a fender bender, so I don’t need to contact the police and file a police report.

Reality: You should always call the police for any accident, regardless of scale. You may realize later that you were hit harder than you thought and are injured. You also may find that your car is more expensive to repair than you thought. In either case, the police report is beneficial when filing a claim with any insurance company.  

Myth: The other driver was at-fault, even the police report says so. I don’t need an attorney; I’ll just file a claim with the insurance company.

Reality: Even if the other driver is clearly responsible, the insurance company won’t want to pay a large claim. They will try to pay you as little as they can because this is the most profitable option for them.
