Florida is one of only 12 states in the nation that has a no-fault car insurance system. If you have recently moved to Boca Raton, Ft. Lauderdale, West Palm Beach or anywhere else in South Florida from one of the other 38 states, it’s important that you understand the differences between this system and the one used in your previous state.
All drivers in Florida are required to carry a $10,000 Personal Injury Protection (PIP) insurance policy as well as a $10,000 Personal Damage/Liability (PDL) policy. If you are involved in an accident, your own PIP plan will pay 80% of your medical expenses, up to $10,000, regardless of whether you or the other party caused the accident. Your PDL will cover damage that you caused to another person’s property.
If the other party is at-fault for your injuries, there are two instances in which you can file a claim against their insurance:
If your situation falls into either of the above two categories, you are able to file a claim that will cover medical bills; lost wages; medication; rehabilitation; assistive devices; lost wages; as well as noneconomic losses, such as pain and suffering and loss of consortium.
While Florida law requires that all drivers carry PIP and PDL insurance policies, the Insurance Information Institute (III) reports that 15.9% of Florida drivers are uninsured[2]. If one of these uninsured drivers seriously injures you in a car crash, and your medical bills/lost wages exceed $10,000, you will have no practical means to recoup these costs from the other driver. For this reason, many drivers choose to purchase Uninsured/Underinsured Motorist coverage in addition to their PIP and PDL coverage. An Uninsured/Underinsured Motorist policy will cover your medical bills and lost wages if you are hit by an uninsured driver, potentially saving you from financial ruin.
Another policy many drivers choose to purchase is a Bodily Injury Liability (BIL) policy. This policy will pay for the medical bills of the other party if you are at-fault for an accident. If you don’t purchase a BIL policy and the other party files a claim against you, they can sue you personally to recover their medical expenses/lost wages, which can put you in a catastrophic financial situation.
