Honesty: The Key to Your Personal Injury Case

After suffering an accident due to the negligence of an individual or a company, you will need to select an experienced and reputable personal injury attorney for your case.  Once you’ve selected your attorney, the most important way you can support your case is to be completely upfront and honest with your attorney.

When you trust your attorney and provide all related information, your attorney can properly prepare your case. 

When you are not completely truthful about your case, if you fail to divulge all relevant details, or if you omit small details, you can destroy your own case.  Dishonesty with your attorney can undermine your case and result in you losing credibility in front of the court. 

Whether you were anticipating compensation in the form of medical bill assistance, lost wages, or loss of future income, any compensation you were hoping the lawsuit would provide would be eliminated.  You will not win a case when you lie.

The way to avoid sabotaging your case is simple although it may not be easy.  Here are a few important points to keep in mind:

  • Your attorney is your partner in this process.  For your attorney to prepare a case on your behalf, he or she needs to understand the complete situation, behaviors, and actions related to the case.   Leaving out a detail (perhaps because you are embarrassed to reveal something) can subvert your case. 
  • You may think that withholding potentially damaging information to you personally or to your claim will help you, but nothing could be further from the truth.  Telling the truth, even if it seems like it could hurt your case, will allow your attorney to plan the best strategy to minimize the impact on your case. 
  • The attorney-client relationship means that your attorney must maintain confidentiality around the information you share.

When discussing the case with your attorney, you need to address the following:

  • The role you played in the accident and how the accident occurred
  • Your medical history including past injuries as well as new injuries since the accident
  • Any medical bills and lost wages due to the accident
  • Previous accidents, injury claims or lawsuits in which you’ve been involved
  • Your work history including if you were or are currently working “under the table”
  • Any workers’ compensation claims you’ve filed
  • Any criminal history
  • Your previous or current bankruptcy filings
  • Your past, current, or future intention to file for divorce
  • Any payments received from Medicare or Medicaid related to accident medical bills
