VIDEO TRANSCRIPT: Hello, I’m attorney Eric Canter and many times I’m asked, “What if I was hit and injured by an uninsured motorist? Do I still have a case?” The answer is, Maybe.
You have to take a look at your own insurance policy and see whether you carry what’s called “Uninsured Motorist Coverage.” Uninsured motorist coverage is coverage that protects you if you’re hit and injured by a driver who didn’t carry any liability insurance coverage. Now, I don’t know if you knew this, but liability insurance coverage isn’t required to operate a car in Florida.
So, if you’re hit and injured by a non-insured motorist, you don’t want to leave it to the coverage from that uninsured motorist. You want to rely on your own coverage and if you have uninsured motorist coverage, that will allow your insurance company to step into the shoes of the uninsured driver so you can make a claim for your injuries against your own insurance company as if you were making a claim against the responsible party.
