“No-Fault” Insurance In Florida
In Florida, all drivers are required to purchase Personal Injury Protection, or PIP, as part of their insurance policy. PIP is often referred to as “no fault” insurance, and you may have even heard Florida referred to as a no-fault state because of PIP coverage. In fact, you may find yourself held liable for personal injuries you cause in an accident, regardless of your PIP coverage. Or, if you are injured in an accident, you may ultimately find this PIP coverage is limited in its ability to pay for your losses and expenses.
Florida legislators enacted PIP requirements in an attempt to prevent and reduce personal injury claims. As such, drivers in our state are required to carry $10,000 in PIP coverage. Although it varies based on deductible, generally PIP will cover up to 80 percent of medical expenses and up to 60 percent of lost wages. PIP is called “no fault” because it pays for your medical bills and lost wages regardless of who caused the accident that injured you – under certain circumstances.
PIP coverage applies when the injuries are not considered “permanent.” If your injury and the other driver’s injury are not permanent, and if your medical expenses and lost wages do not exceed $10,000, then PIP coverage generally prevents you from suing each other; however, when your medical bills and lost wages exceed $10,000, then the no-fault law does not apply and you may pursue a personal injury claim.
If, however, your injury is considered “permanent,” then the limitations of PIP coverage do not apply in the sense that you are not subject to no-fault rules: You may pursue a claim against the responsible driver. Here are the current definitions of a permanent injury according to Florida law:
- Significant and permanent loss of an important bodily function
- Permanent injury within a reasonable degree of medical probability, other than scarring or disfigurement
- Significant and permanent scarring or disfigurement
- Death
