How Can I Collect Damages from a Distracted Driver who Injured Me in South Florida?

Posted on April 14, 2025

April is Distracted Driving Awareness Month. Distracted driving is a major threat to all of us on the South Florida roads. In 2022, 289,310 individuals were injured in car crashes involving distracted driving and another 3,308 were killed[1]. Distracted driving accidents collectively cost U.S. society $395 billion each year[2].

Many drivers in Boca Raton erroneously believe that distracted driving only refers to texting while driving. While this is one type of distracted driving, others include changing the radio station, talking on your cellphone, talking to passengers in the car, eating or drinking, putting on make-up, rubbernecking, or any other activity that takes away your focus from the road.

If you are involved in an accident and suspect that the driver that hit you was distracted, the first step is to call 911, as is the case for any car accident. Take photographs of the accident scene, including both cars. Also take photos of any external distractions, such as construction, an accident on the other side of the road, or anything else that could have distracted the other driver. This could be important evidence if you end up filing a personal injury lawsuit against them. Similarly, take down the contact information for any witnesses; they could have observed something important that corroborates your version of the accident.

When the police arrive, tell them about any behavior you witnessed from the other driver that suggests they were distracted, such as if you saw them holding a cell phone, eating, or if they appeared to be having a heated conversation with a passenger. Also, provide them with the witness contact information that you collected.

After you leave the scene of the accident, go straight to an urgent care facility or hospital to document any injuries and start treatment right away so that you can begin your healing process.

The next step is to contact a personal injury attorney, such as ECanter Lawyers, to file a claim against the driver who hit you to recover compensation. In addition to reviewing a copy of your police report, photos and videos of the scene, and your medical records, your attorney will also seek any traffic camera or security camera footage that may have caught the accident. They may also seek a copy of the other driver’s cell phone records to determine if they were on the phone or texting at the time of the accident.

Distracted driving is a serious problem on our roads. If you are the victim of a car crash caused by a distracted driver, call ECanter Lawyers to learn about your rights to compensation for your injuries.
