What to Do If You Are Injured by a Defective Product

We like to believe that the everyday products we use are safe. Usually, they are, but not always. Here are some examples of the types of injuries that a defective everyday product can cause:

  • You’re boiling water in an electric kettle and it explodes, sending shards of glass and boiling hot water all over you and everything else in your kitchen.
  • You sit down in a recliner, and it collapses, breaking several of your bones and trapping you in it until your spouse comes home and rescues you.
  • Your child is on the new swing set in the backyard. The swing cracks in half while your child is mid-air, causing them to come crashing down and suffer a concussion and broken bones.

  • Seek medical care immediately. The longer you wait, the easier it will be for the opposing side to claim your injuries were caused by something other than their product. At the hospital or doctor’s office, explain to them what you were doing when you were injured, so there is documentation that the injury was caused by the defective product. It’s also essential to follow through with any follow-up appointments, specialist appointments, physical therapy, medication, psychological evaluations, or any other medical advice you receive. You will need to prove that you did everything you could to heal from your injuries.
  • Save the defective item and all its parts. You will need these for evidence. If you have the receipt from when you purchased the item, that will be helpful as well.
  • You may be tempted to clean up any messes caused by the defective product right away. Don’t do it. Take photos and narrated videos showing the scene of the accident. This will help prove the severity of the situation. Take photos of your injuries. If anyone witnessed the incident, provide that person’s contact information to your attorney so they can contact them to provide corroborating evidence.
  • Avoid posting on social media. This includes both posting about the incident itself and posting about anything else, even if it is unrelated to the incident. No matter how private and secure you think your social media accounts are, the opposing side may be able to access them. Anything they find they can use to try and prove that your injuries are not as serious as you are claiming.
