Your rights in an accident involving a drunk driver are the same as if you were involved in an accident with an individual who was not intoxicated.  However, you may be entitled to recover punitive damages against the driver who caused the car accident while drunk.  Punitive damages are those that are designed to punish certain behavior, and are awarded  by a jury in addition to compensatory damages, which are the losses you sustained as a result of the automobile accident.  Examples of compensatory damages in a car accident include compensation for your physical injuries, wage loss in the past and future, and pain and suffering.

Contact the police.  Do not leave the scene until the police arrive.

Take photographs of the scene.

If you are injured, get yourself and your passengers to a hospital.

Take photographs of the damages to all of the cars involved in the crash.

While at the hospital, or seeing a medical professional, be detailed about your injuries.  It’s helpful for the healthcare professional to know the extent of your injuries in a car accident so that you can get the proper care, and so the that your injuries are properly documented.
